Why can't some condos get a conventional loan?
Because Fannie Mae won't finance certain types of buildings (Selling Guide B4-2.1-03). Three come up often with beach high-rises:
- Run like a hotel. Buildings managed and run as a hotel or motel are ineligible, even if each unit has its own owner. Fannie Mae points to hotel-type services like a front desk, daily or short-term rentals, daily cleaning, central key systems and limits on interior decorating. Buildings that are mostly short-stay guests also count.
- Lawsuits. Buildings where the HOA is part of a pending lawsuit are generally ineligible, with limited exceptions.
- Major repairs. Buildings that need critical repairs, like water leaks or a lot of put-off maintenance, are ineligible until the issue is fixed.
Units under 400 square feet are a red flag that calls for extra review. When a building doesn't fit, non-QM (loans outside the standard agency rules) or DSCR financing may still work, usually on different terms. That's why I ask for the condo questionnaire and budget at the start, not the week before closing.
Who needs the rental license in Orange Beach?
The owner. The city says anyone doing business in Orange Beach needs a business license. Its Finance Department FAQ says the license to rent a condo or house is the owner's job, not the management company's. The Finance Department collects local lodging tax, figured on the rental rate, cleaning fee and parking passes where they apply.
Outside the condo towers, Orange Beach controls short-term rentals through zoning and licensing. If you plan to rent a house short-term, confirm with the city that the zoning allows it before you count on that income.
Can a condo in a rental program be a second home?
It depends on the contract. Many towers have an on-site rental program. Fannie Mae says a second home can't be under any agreement that gives a management company control over who stays there. So the terms of a rental contract matter. If you plan to put the unit in a rental program, tell me up front. We'll decide together whether it should be financed as an investment property.
One more Orange Beach detail: the state's Strengthen Alabama Homes grant excludes condos, so condo owners shouldn't count on it. Ask your agent about the building's master insurance policy, your own unit coverage and wind deductibles instead.
What this means for your mortgage
- Get the HOA's budget, questionnaire and insurance details early.
- Ask if the building has a rental desk or hotel-style services.
- Decide second home or investment before you apply.
Common fits: conventional for eligible buildings, DSCR, non-QM, jumbo and asset depletion. Estimate rental income with the DSCR calculator, and read my Alabama Gulf Coast guide for closing taxes.
Orange Beach mortgage questions
Why can't some Orange Beach condos get a conventional loan?
Fannie Mae treats buildings run like hotels, buildings with HOA lawsuits and buildings needing critical repairs as ineligible. Those units may still be financed through non-QM or DSCR programs, subject to guidelines.
Who needs the rental license if a management company handles bookings?
The owner. The City of Orange Beach's Finance Department says the license is the owner's job, not the management company's.
Can my Orange Beach condo be a second home if it's in a rental program?
It depends on the agreement. Fannie Mae doesn't allow a second home to be under an agreement giving a management company control over who stays there. Bring me the contract before you sign.
Does Strengthen Alabama Homes cover condos?
No. The program excludes condos and requires an owner-occupied, single-family main home.
