What is Fairhope Single Tax land?
It's land you lease instead of buy. The Fairhope Single Tax Corporation dates back to 1894 and was incorporated in Alabama in 1904. The Corporation says it owns about 4,500 acres, roughly a quarter of Fairhope. On that land you don't buy the dirt. You buy the house and other improvements, and you lease the land on a 99-year renewable lease.
The Corporation says a building on its land changes hands by bill of sale, and the buyer leases the land. Any change in owners goes through the Corporation's transfer process. That includes a transfer letter, transfer fees paid before orientation can be scheduled, and catching up any past-due rent before a new lease is issued. The Corporation also has a form for refinances and home equity lines.
Heads up: Build the Corporation's transfer steps into your contract timeline. Your closing agent, your agent and I all need the same lease details early.
Can you get a mortgage on a leasehold home?
Yes, but the lease gets reviewed. With a leasehold (you own the house but lease the land), the lender is lending against your lease and the house. Each loan program has its own test. The "maturity date" below means the date your loan is scheduled to be paid off.
- Conventional (Fannie Mae): the lease must run at least five years past the loan's maturity date. It also has to allow the leasehold to be mortgaged and transferred, give the lender notice and a chance to fix things if the lessee defaults, and protect the lender in a condemnation (Selling Guide B2-3-03).
- FHA: federal rules accept a lease of not less than 99 years that is renewable, or one with at least 10 years left beyond the mortgage's maturity (24 CFR 203.37).
- VA: the lease must run, or be renewable at the lessee's option, for at least 14 years past the loan's maturity, and it must be assignable, meaning it can be passed to a new owner (38 CFR 36.4354).
Meeting the agency rule is just the start. Each lender and investor can add its own leasehold rules. So I confirm the specific lease will be accepted before we settle on a plan.
How does the yearly Single Tax rent affect my payment?
It takes the place of a normal tax estimate. The Corporation says its rent includes the taxes due on the land and the improvements, plus admin fees based on the land's appraised value. Rent is billed once a year. For 2026, the Corporation offers a discount for paying in full by November 2 and sets the full due date at December 1.
So a Single Tax home doesn't fit neatly into the way a typical estimate shows property taxes. I'd rather work from the actual lease rent than a guess. Ask the seller or the Corporation for the current amount. I'll build it into your payment and your escrow plan (escrow is the account that pays your taxes and insurance).
What this means for your mortgage
- Find out early if the home is fee simple (you own the land too) or Single Tax leasehold. It changes which documents we need.
- Get a copy of the lease and the current rent amount before you're deep into the contract period.
- Check the flood zone by address on FEMA's map. Fairhope runs from the bayfront to higher ground.
- Buying a lot to build? Ask about a construction-to-permanent loan.
Loans that come up most here: conventional, FHA, VA and jumbo. Run the numbers with the payment calculator or affordability calculator. For coastal insurance and closing taxes, read my Alabama Gulf Coast guide.
Fairhope mortgage questions
Can I get a mortgage on a Fairhope Single Tax home?
Leasehold homes can be financed, subject to credit approval, program guidelines and property eligibility. The lease has to meet the loan program's leasehold rules and the lender's own rules, so I review it first.
Do I own the land with a Single Tax home?
No. The Fairhope Single Tax Corporation says lessees own the improvements and lease the land on a 99-year renewable lease.
How do property taxes work on Single Tax land?
The Corporation says its yearly rent includes the taxes due on the land and improvements. Ask for the current rent amount so your payment estimate shows the real cost.
Can I refinance or get a HELOC on a Single Tax home?
The Corporation has a Request for Refinance Statement form for refinances and home equity lines. Whether a lender accepts the leasehold for a refinance depends on its guidelines.
